The National and State Houses of Assembly Election Tribunal has dismissed the petition by Johnson Ganiyu Abiodun, challenging the victory of Labour Party’s Okey-Joe Onuakalusi in the Oshodi/Isolo II Federal constituency election. The tribunal upheld Onuakalusi’s win, affirming that he was duly qualified and legitimately elected with 29,386 votes, as declared by INEC.
The National and State Houses of Assembly Election Tribunal has dismissed the petition filed by Johnson Ganiyu Abiodun challenging the victory of Labour Party’s (LP), Okey-Joe Onuakalusi representing Oshodi/Isolo II Federal constituency at the National Assembly.
Respondents in the petition were the Independent National Electoral Commission (INEC), Onuakalusi and LP.
INEC declared Onuakalusi winner of the February 25, 2023 election with a total of 29,386 votes as against 16,650 scored by the petitioner (Abiodun).
Dissatisfied with the result, Abiodun filed the petition, praying the court to declare that the 2nd respondent (Onuakalusi) was at the time of the election not qualified to contest for it.
In the judgment delivered by Hon. Justice A.B Abdullahi as chairman, Hon. Justice Okon A. Okon and Esther Nnenna Alukwu as members, affirmed and upheld the election and return of the 2nd respondent as winner of the House of Representatives, Federal Constituency Oshodi/Isolo, Lagos state.
“This tribunal, fortified by the decision of the Court of Appeal (Exhibit p2c) in Appeal No. CA/ABJ/CV/1041/2022 Barr. Jesse Okey Joe Onuakalusi & 16 ORSV. INEC, the content of Exhibit RW3B and RW4B as well as the evidence of RW1, 2 and 3, is of the opinion that the 2nd respondent is a member of the 3rd respondent and duly sponsored by the 3rd respondent to contest for the election of House of Representatives Oshodi/Isolo Federal Constituency II, Lagos state.
“The issue is accordingly resolved against the petitioner,” Justice Abdullahi declared.
